Notice
Regarding Polysomnographic Testing
Take notice
that on December 21, 2005, the effective date of the "Polysomnography Practice
Act" (P.L. 2005, c. 244), the State Board of Respiratory Care determined to
rescind its Notice that appeared in the May 5, 2003 New Jersey Register, 35
N.J.R. 1963(a), notifying the polysomnography community that on and after April
30, 2006, the State Board of Respiratory Care would begin to take enforcement
action against individuals it becomes aware are performing polysomnographic
testing procedures that fall within the scope of respiratory care practice
without a license to practice respiratory care, with the exception of health
care providers licensed by appropriate agencies of the State of New Jersey,
provided such duties are consistent with the accepted standards of the member's
profession and the member does not present himself or herself as a respiratory
care practitioner.
The State Board of Respiratory Care has determined that it will not take enforcement action against such individuals since these individuals will now have to be licensed by the State Board of Polysomnography in order to perform polysomnographic testing procedures that may fall within the scope of respiratory care practice.
